Areas of Expertise

Neil’s responsibilities include conducting housing litigation which involves defending disrepair claims and advising clients of settlements, bringing actions for nuisance such as possession proceedings, Anti-Social Behaviour Injunctions, bringing possession actions for unlawful sub-letting, non-occupation and disputed succession claims. Neil also conducts general property litigation which includes both residential and commercial properties. This includes claims for forfeiture, business lease renewal claims under Landlord and Tenant Act 1954, service charge disputes including recovery of unpaid service charges and s20 consultation and Judicial Review. Neil also provides non-contentious advice in respect of housing and leasehold management and general property matters.


Experience

Prior to Devonshires Solicitors, Neil worked as a Solicitor at Prince Evans in the Litigation Department dealing with Landlord and Tenant disputes involving Anti-Social Behaviour, squatters and disrepair.

Notable Cases

Neil acted for Circle 33 Housing Trust Ltd in the Court of Appeal case of Lawal - v - Circle 33 Housing Trust Limited( EWCA Civ 1514 whereby Devonshires Solicitors successfully resisted an occupiers’ efforts under Article 8 to prevent an eviction.

Neil acted for Newlon Housing Trust in a case involving a contested claim to succession by the deceased’s tenant’s son. Newlon obtained possession after discovering the tenant’s son held a tenancy elsewhere and obtained a costs order against the son which was recovered after securing a charging order against a property also owned by the tenant’s son.

Neil is advising a Registered Provider client in respect of forfeiture of a commercial lease due to unpaid rent.
