Litigation

Partner

James is a Partner in the Litigation and Dispute Resolution Department and specialises in civil & criminal litigation, particularly fraud, armed forces and regulatory work.

James represents public and private businesses and regulators who have been the victim of fraud, carrying out detailed investigations, and recovering assets. He also acts for the defence - those who are being investigated or pursued for assets, either by public bodies, or by victims.

James has acted for numerous businesses that have discovered they are the victim of fraud. From the initial discovery right through to the physical recovery of assets, he has experience of investigating and advising, including liaising with regulatory bodies and the police. Of particular use is his accountancy background, which allows him to deal effectively in a team of investigators, and gives him an understanding outside the traditional legal framework.

James also undertakes a wide variety of commercial and other litigation cases, including negligence actions and contractual disputes.

Recent cases include:

  • Defending a €2 billion claim in the Commercial Court for alleged breaches of fiduciary duties, also involving proceedings in Austria and Slovakia;
  • Acting as the Solicitors Regulation Authority’s agent in interventions into solicitors’ firms and representing the SRA in a number of multi million pound asset recovery cases that arise following those interventions, together with other litigation on behalf of the Solicitors Regulation Authority; and
  • Acting for over 45 soldiers involved in the Historic Enquiries Team (HET) investigations in Northern Ireland.
