Costs and risk can make commencing court or other proceedings unattractive. On the other hand, negotiations between parties often become bogged down and discussions stall. This is where mediation comes in. Contracts and agreements often require parties to participate in mediation as a means of resolving disputes (often as a step in a “Dispute Resolution Procedure”) but those involved can be unsure about when to try mediation and how it works or how to suggest using a mediator when there’s no contractual requirement to do so.
