We have seen a marked increase in enforcement activity by the Building Safety Regulator over the past months as it begins to get to grips with its powers and flex its muscles. Therefore, it is an opportune time to review the position on enforcement of health & safety and building safety breaches.

In this seminar we will take you through the wide range of enforcement powers available to the BSR, HSE and Fire & Rescue Services, the investigation process and the practical steps that you should take when facing an investigation.

This two-and-a-half-hour seminar will be of benefit to Clients on construction projects, Accountable Persons for HRBs and Responsible Persons under fire safety regulations

Speakers

Mark London, Partner, Construction, Engineering and Procurement.

Mark is Senior Partner at Devonshires and heads up our Construction, Engineering and Procurement team. The team is made up of over 30 specialist construction lawyers carrying out work across a diverse range of sectors within the industry. Their clients include registered providers of social housing, local authorities, developers, sub-contractors and private individuals. The team operate from offices in London, Leeds, and Colchester.

Mark specialises in dispute resolution work which involves litigation in the Technology and Construction Court, adjudication and arbitration. This work covers all aspects of construction and asset management. Mark also advises clients on all aspects of European procurement law and regularly acts for contracting authorities and economic operators in procurement disputes.

Our Construction, Engineering and Procurement team also has a large team of transactional construction lawyers, led by Asif Patel, that are instructed on large construction and development schemes and specialise in drafting and negotiating all forms of construction contracts and associated agreements.

Kathryn Kligerman, Partner, Construction, Engineering and Procurement

Kathryn leads the specialist health & safety team at Devonshires.  Kathryn has a specialist focus on crisis management and supporting clients in the immediate aftermath of a health & safety incident, including managing stakeholders and media involvement. Clients benefit from Kathryn’s calm manner when dealing with what can be highly stressful and emotional circumstances.

Kathryn advises clients in relation to criminal investigations and prosecutions under the Health & Safety at Work etc. Act 1974, the Regulator Reform (Fire Safety) Order 2005 and subordinate legislation. Kathryn has experience liaising with and responding to investigations by regulatory bodies (whether that is the Health & Safety Executive, the Police, the local fire & rescue service or the local authority).

As well as dealing with prosecutions, Kathryn has extensive experience acting for building owners and landlords in the coronial inquest process following an unexplained death, providing invaluable advice to clients trying to navigate other potentially inter-related prosecutions (criminal and civil).

Yaasica Hamilton-Haye, Senior Associate, Construction, Engineering and Procurement

Yaasica advises clients in relation to investigations, enforcement and prosecution under the Health and Safety at Work etc. Act 1974 and the Regulatory Reform (Fire Safety) Order 2005. She has developed a particular expertise in providing crisis management to clients in the aftermath of a large-scale disaster or serious incidents involving dangerous occurrences, injuries or fatalities.

Yaasica assists clients in carrying out thorough internal investigations into health and safety incidents, along with assisting co-ordinated responses to regulatory bodies such as the Health and Safety Executive, the Fire and Rescue Service, the Police and the Regulator of Social Housing. Yaasica has experience in acting for building owners and landlords in the coronial inquest process, when an unexplained fatality has occurred in a property arising from a health and safety related incident.

On the non-contentious side, Yaasica provides training and policy reviews for residential building owners and landlords to ensure existing asset compliance with all Health & Safety and Building Safety legislation and regulations. Yaasica also provides advice and guidance for Responsible Persons, Accountable Persons and Principal Accountable Persons.
