Building Safety (Wales) Bill Examined

The landmark Building Safety (Wales) Bill has now been released.

This marks a significant step towards the enhancement of building safety across Wales. Much like the Building Safety Act 2022, it aims to fundamentally transform safety in residential buildings.

The Bill will introduce new dutyholder positions and a number of new building safety duties, establish new resident protections and create a new enforcement regime.

The Bill does not create an identical building safety regime as that implemented in England; therefore, it is vital for those responsible for residential buildings to get to grips with the changes before it comes fully into force.

This webinar will review the Bill, highlighting the significant changes, main new duties, key differences from the English regime and offer practical tips for compliance.

Mark London, Partner, Construction, Engineering and Procurement

Mark is Senior Partner at Devonshires and heads up our Construction, Engineering and Procurement team. The team is made up of over 30 specialist construction lawyers carrying out work across a diverse range of sectors within the industry. Their clients include registered providers of social housing, local authorities, developers, sub-contractors and private individuals. The team operate from offices in London, Leeds, and Colchester.

Mark specialises in dispute resolution work which involves litigation in the Technology and Construction Court, adjudication and arbitration. This work covers all aspects of construction and asset management. Mark also advises clients on all aspects of European procurement law and regularly acts for contracting authorities and economic operators in procurement disputes.

Our Construction, Engineering and Procurement team also has a large team of transactional construction lawyers, led by Asif Patel, that are instructed on large construction and development schemes and specialise in drafting and negotiating all forms of construction contracts and associated agreements.

Lee Russell, Partner, Housing Management and Property Litigation

Lee is Head of Devonshires’ Housing Management & Property Litigation team.

Lee was one of the first solicitors to qualify as part of the Solicitors Regulation Authority’s fully qualifying law degree. He was one of the youngest qualifying solicitors at the time.

Lee advises on all aspects of housing management and property litigation, regularly advising private organisations, land owners, developers, investors, charities, local authorities and some of the largest providers of social housing in the United Kingdom.

Lee’s specialism in complex dispute resolution, both in and out of court, sits alongside his extensive experience in advising on non-contentious policy and procedure in addition to regulatory matters. Lee has a developed specialism in fire safety issues and property litigation aspects to contentious construction disputes.

Lee also deals with broader property litigation matters including adverse possession, service charge issues, lease disputes, trespass, restrictive covenants/easements and boundary issues. Lee leads our dedicated Wales team, advising registered social landlords on all aspects of housing management, property litigation and topical Welsh issues.

Ellie Fletcher, Associate, Construction, Engineering and Procurement

Ellie is an Associate in our Construction, Engineering and Procurement team specialising in contentious construction matters.

Ellie has experience of mediation, High Court litigation and adjudication. Ellie acts for employers, developers and architects on contentious matters. Ellie regularly advises in relation to insurance matters most commonly building warranty claims and claims under professional indemnity policies.

Ellie also advises a variety of clients in relation to their obligations under current and upcoming fire safety legislation.
